Prior to today's hearing, FHFA alerted the panel to the Federal Circuit's Arthrex decision to bolster its argument there was no Appointments Clause transgression. The Rop Plaintiffs didn't agree with that reading. The parties' letters about the Arthrex decision are attached to this e-mail message.
