The parties submitted a third status report to the Sixth Circuit's Mediation Office last week.  Briefing remains in abeyance pending receipt of another status report on Sept. 23, 2021.  A copy of the mediator's letter memorializing this action is attached to this e-mail message.

Fairholme v. U.S

The Federal Circuit has scheduled oral argument on the appeals from Judge Sweeney's decisions for 10:00 a.m. on Wed., Aug 4.  The hearing will be held by telephone.  If public access to that conference call is not permitted, the clerk usually makes recordings available by the end of the day.
