DEFENDANT’S NOTICE WITH RESPECT TO APPLICATIONS OF ROBERT CORSO,
MARK McMAHON, MARIA NIZZA, NIKHIL RUPANI, CHRISTO TZANKOV, AND
JOHN CAMPBELL FOR ACCESS TO PROTECTED INFORMATION

Pursuant to paragraph 7 of the Protective Order in this case, the United States respectfully advises the Court that it withdraws its opposition to the six applications for access to protected information filed by plaintiffs on January 26, 2015 (Doc. 125. The premise of our opposition was the pendency of our motion to stay proceedings pending the outcome of the appeals in Perry Capital LLC v. Lew (No. 5243, D.C. Cir.), and our position that access to protected information should not be permitted if discovery ultimately were stayed. During the January 28, 2015 status conference, however, the Court stated that it intended to deny the motion to stay. Assuming that it remains the Court’s intent to deny the motion to stay, we withdraw our objection to the applications for access to protected information.
