Thomas D. Zimpleman, Esq., representing the U.S. Treasury, entered his appearance yesterday, and a copy of his Notice of Appearance is attached to this e-mail message.

Judge Chang observed that FHFA referred to an order entered in the Saxton case in its response to Fairholme’s motion to file an amicus brief.  Judge Change would like to see that order and has directed FHFA’s counsel to tender a copy to the court.  Further, Judge Change has kicked the Nov. 14 status hearing to Nov. 29.  and a copy of Judge Chang’s minute order to that effect is attached to this e-mail message.16-02107-0061 16-02107-0062

As you know, Arnold & Porter serves as FHFA’s legal counsel in every case in which FHFA has an interest.

I have no positive or negative opinion about Arnold & Porter merging with Kaye Scholer.  Both have been top-notch firms for decades.
