I want to see if a judge can say that Lamberth’s ruling that the facts don’t matter can be used as an umbrella to prevent facts that another judge ruled were improperly withheld simply are not relevant when an amicus brief claims they are… i think that this puts Roberts into extra innings post lamberth. score.

 

Fairholme wants permission to appear as amicus curiae in Roberts v.
