Justice department, FHFA & Treasury say that MDL is needed because of “one or more common facts”. But MDL requires “at least two common facts”. That means MDL needs “two or more common facts”. The Jacob case does not have two common facts with other three litigations. The corporate law and APA are two different laws therefore they cannot be combined for MDL.
The justice department is trying to fool judges.
