In an attempt to expedite obtaining a clear answer about whether the Net Worth Sweep is legal or illegal under Delaware and Virginia, Messrs. Jacobs and Hindes are asking Judge Sleet to pose the question to those two states’ courts. A copy of the application filed this afternoon asking for the question to be certified to the state courts is attached to this e-mail message.
FHFA and Treasury will predictably oppose the request, and tell Judge Sleet the answers are meaningless for the same reasons already articulated in the Motions to Dismiss. 15-00708-0024
