Pershing Square and the other Rafter Plaintiffs wants to file an Amicus Brief with the U.S. Court of Appeals for the Federal Circuit in Piszel v. U.S.  A copy of Pershing Square’s motion is attached to this e-mail message in addition to the Court’s order directing that responses be filed withing five days and replies be filed within two days thereafter.

The Rafter Plaintiffs want to argue that Judge Griggsby’s dismissal of Mr. Piszel’s takings claim was flawed because of her reliance on Judge Lamberth’s decision in Perry v. Lew which is also flawed and now on appeal before the D.C. Circuit.
